In my opinion, the greatest collection of Philosophical works ever put in a single collection. Many of these groundbreaking works of their time, are not in print by anyone else today. Many have been cleaned up grammatically by Liberty Fund, and several are original first time English translations by them. Liberty Fund publishes two or three classic titles in this series each year. I will create addendums as they do. - RadicallyLiberal

1603 - Hugo Grotius
Commentary on the Law of Prize and Booty
The history of Commentary on the Law of Prize and Booty is complex. When Grotius’s personal papers were auctioned in The Hague in 1864, scholars discovered that Mare Liberum was just one chapter in a manuscript of 163 folios, written in justification of the capture of the Portuguese merchantman Santa Catarina in the Strait of Singapore in February 1603. Robert Fruin persuaded the scholar H. G. Hamaker to transcribe and publish it in 1868. The Liberty Fund edition is based on the one prepared by Gwladys L. Williams and Walter H. Zeydel for the Carnegie Endowment for International Peace. It combines the original text and new material.

Grotius’s influential argument in favor of freedom of navigation, trade, and fishing in Richard Hakluyt’s translation. The book also contains William Welwod’s critque and Grotius’s reply to Welwod.

The Rights of War and Peace vol. 2
The Rights of War and Peace vol. 3
Grotius’s Rights of War and Peace is a classic of modern public international law which lays the foundation for a universal code of law and which strongly defends the rights of individual agents - states as well as private persons - to use their power to secure themselves and their property. This edition is based upon that of the eighteenth-century French editor Jean Barbeyrac and also includes the Prolegomena to the first edition of Rights of War and Peace (1625); this document has never before been translated into English and adds new dimensions to the great work.

1652 - Nathaniel Culverwell
An Elegant and Learned Discourse of the Light of Nature
An Elegant and Learned Discourse of the Light of Nature is a concerted effort to find a middle way between the two extremes that dominated the religious dispute of the English civil war in the seventeenth century. At one extreme end of the spectrum was the antinomian assertion that the elect were redeemed by God’s free grace and thereby free from ordinary moral obligations. At the other end of the spectrum was the Arminian rejection of predestination and assertion that Christ died for all, not just for the elect. Faced with the violence of these disputes, Nathaniel Culverwell attempted a moderate defense of reason and natural law, arguing, in the words of Robert Greene, that “reason and faith are distinct lights, yet they are not opposed; they are complementary and harmonious. Reason is the image of God in man, and to deny right reason is to deny our relation to God.”

1660 - Samuel von Pufendorf
Two Books of the Elements of Universal Jurisprudence
This was Pufendorf’s first work, published in 1660. Its appearance effectively inaugurated the modern natural-law movement in the German-speaking world. The work also established Pufendorf as a key figure and laid the foundations for his major works, which were to sweep across Europe and North America. Pufendorf rejected the concept of natural rights as liberties and the suggestion that political government is justified by its protection of such rights, arguing instead for a principled limit to the state’s role in human life.

1672 - Richard Cumberland
A Treatise of the Laws of Nature
A Treatise of the Laws of Nature, originally titled De Legibus Naturae, first appeared in 1672 as a theoretical response to a range of issues that came together during the late 1660s. It conveyed a conviction that science might offer an effective means of demonstrating both the contents and the obligatory force of the law of nature. At a time when Hobbes’s work appeared to suggest that the application of science undermined rather than supported the idea of obligatory natural law, Cumberland’s De Legibus Naturae provided a scientific explanation of the natural necessity of altruism.

1673 - Samuel von Pufendorf
The Whole Duty of Man According to the Law of Nature
The Whole Duty of Man (first published in Latin in 1673), was among the first works to suggest a purely conventional basis for natural law. Rejecting scholasticism’s metaphysical theories, Pufendorf found the source of natural law in humanity’s need to cultivate sociability. This edition also includes he very important editorial material from Jean Barbeyrac’s French editions and are here translated into English for the first time.

1680s-1690s??? - Christian Thomasius
Essays on Church, State, and Politics
The essays selected here for translation derive largely from Thomasius’s work on Staatskirchenrecht, or the political jurisprudence of church law. These works, originating as disputations, theses, and pamphlets, were direct interventions in the unresolved issue of the political role of religion in Brandenburg-Prussia, a state in which a Calvinist dynasty ruled over a largely Lutheran population and nobility as well as a significant Catholic minority. In mandating limited religious toleration within the German states, the provisions of the Peace of Westphalia (1648) also provided the rulers of Brandenburg-Prussia with a way of keeping the powerful Lutheran church in check by guaranteeing a degree of religious freedom to non-Lutherans and thereby detaching the state from the most powerful territorial church. Thomasius’s writings on church-state relations, many of them critical of the civil claims made by Lutheran theologians, are a direct response to this state of affairs. At the same time, owing to the depth of intellectual resources at his disposal, these works constitute a major contribution to the broader discussion of the relation between the religious and political spheres.

1686 - Pierre Bayle
A Philosophical Commentary on These Words of the Gospel, Luke 14.23,
‘Compel Them to Come In, That My House May Be Full’
In this defence of religious toleration, Bayle discusses the words attributed to Jesus Christ in Luke 14:23, “And the Lord said unto the servant, Go out into the highways and hedges, and compel them to come in, that my house may be full.” Bayle contends that the word compel cannot mean “force.” From this perspective, he constructs his doctrine of toleration based on the singular importance of conscience. Bayle argues that if the orthodox have the right and duty to persecute, then every sect will persecute since every sect considers itself orthodox. The result will be mutual slaughter, something God cannot have intended.

1687 - Samuel von Pufendorf
Of the Nature and Qualification of Religion, in Reference to Civil Society
In this work Pufendorf argues for the separation of politics and religion. Written in response to the revocation of the Edict of Nantes by the French king, Louis XIV, Pufendorf contests the right of the sovereign to control the religion of his subjects, because state and religion pursue wholly different ends. He concludes that, when rulers transgress their bounds, subjects have a right to defend their religion, even by the force of arms.

The Divine Feudal Law: Or, Covenants with Mankind, Represented
The Divine Feudal Law sets forth Pufendorf’s basis for the reunion of the Lutheran and Calvinist confessions. This attempt to seek a “conciliation” between the confessions complements the concept of toleration discussed in Of the Nature and Qualification of Religion in Reference to Civil Society. In both works Pufendorf examines the proper way to secure the peaceful coexistence of different confessions in a state.

1696 - Samuel von Pufendorf
The Present State of Germany
Although The Present State of Germany was first made available in English over three centuries ago, it has been virtually unavailable in English since the period of the American Founding. By 1696, Pufendorf was well known in England as a staunch defender of the Protestant cause and as one of the renovators of natural law. His writings were familiar to such luminaries as Locke and figured prominently in James Tyrell’s Patriarcha non Monarcha (1681). The editor of this volume, Michael J. Seidler, describes this work of Pufendorf as “an account of German constitutional law detailing the historical relations between the Emperor and the Estates as well as an examination of the legitimating foundations of Imperial authority, a general analysis of the nature and requirements of political sovereignty, and a reconceptualization of the different forms of political order… . Its central distinction between so-called regular and irregular states, resting on the question of the locus of sovereignty, demotes the traditional political categories into mere administrative possibilities and thereby creates a more general problematic of freedom and authority with which we are still wrestling today. That is, it raises, at a very early stage in the contractarian tradition which we have inherited, the basic question of how effective political unity is compatible with competing values of diversity and individual liberty.”

1724 - Gershom Carmichael
Natural Rights on the Threshold of the Scottish Enlightenment: The Writings of Gershom Carmichael
Carmichael was a Scottish jurist and philosopher who became the first Professor of Moral Philosophy at the University of Glasgow in 1727. His writings on natural rights theory, theology, and logic were very influential.

1726 - Francis Hutcheson
An Inquiry into the Original of Our Ideas of Beauty and Virtue
A seminal text of the Scottish Enlightenment which was written as a critical response to the work of Bernard Mandeville and as a defense of the ideas of Anthony Ashley Cooper, Lord Shaftesbury. It consists of two treatises exploring our aesthetic and our moral abilities.

1730 - Francis Hutcheson
Logic, Metaphysics, and the Natural Sociability of Mankind
Until the publication of this Liberty Fund edition, all but one of the works contained in Logic, Metaphysics, and the Natural Sociability of Mankind were available only in Latin. This milestone English translation will provide a general audience with insight into Hutcheson’s thought. In the words of the editors: “Hutcheson’s Latin texts in logic and metaphysics form an important part of his collected works. Published respectively in 1756 and, in its second edition, 1744, these works represent Hutcheson’s only systematic treatments of logic, ontology, and pneumatology, or the science of the soul. They were considered indispensable texts for the instruction of students in the eighteenth century.”

1740 - George Turnbull
Vol. 1: The Principles of Moral Philosophy
Vol. 2: Christian Philosophy
The Principles of Moral and Christian Philosophy presents the first masterpiece of Scottish Common Sense philosophy. This two-volume treatise is important for its wide range of insights about the nature of the human mind, the foundations of morals, and the relationship between morality and religion. In order to understand the Enlightenment in Scotland, Turnbull’s work must be put next to that of Francis Hutcheson. In the first volume, The Principles of Moral Philosophy, Turnbull presents a detailed study of the faculties of the human mind and their interrelations. He contends that moral philosophy should be treated as one part, the highest part, of natural philosophy, and not as a field requiring its own distinctive methodology.

An Essay on the Nature and Conduct of the Passions and Affections, with Illustrations on the Moral Sense
The first half of the work presents a rich moral psychology built on a theory of the passions and an account of motivation deepening and augmenting the doctrine of moral sense developed in the Inquiry. The second half of the work, the Illustrations, is a brilliant attack on rationalist moral theories and is the font of many of the arguments taken up by Hume and used to this day.

1742 - Francis Hutcheson
Marcus Aurelius Antoninus
The Meditations of the Emperor Marcus Aurelius Antoninus
This influential classical work offered a vision of a universe governed by a natural law that obliges us to love mankind and to govern our lives in accordance with the natural order of things. In their account of the life of the emperor, prefaced to their translation from the Greek, Hutcheson and Moor celebrated the Stoic ideal of an orderly universe governed by a benevolent God. They contrasted the serenity recommended and practiced by Marcus Aurelius with the divisive sectarianism then exhibited by their fellow Presbyterians in Scotland and elsewhere. They urged their readers and fellow citizens to set aside their narrow prejudices.

1742 - George Turnbull
Observations upon Liberal Education, in All its Branches
Turnbull was the first member of the Scottish Enlightenment to provide a formal treatise on the theory and practice of education. He applied his ideas on the moral sense to the education of youth. Turnbull showed how a liberal education enables youth to realize a true “inward liberty” and moral strength and thus prepares them to live responsibly and happily in a free society.

1747 - Francis Hutcheson
Philosophiae moralis institutio compendiaria with a Short Introduction to Moral Philosophy
This Liberty Fund publication of Philosophiae Moralis Institutio Compendiaria is a parallel edition of the English and Latin versions of a book designed by Hutcheson for use in the classroom. General Editor Knud Haakonssen remarks that “Hutcheson’s Institutio was written as a textbook for university students and it therefore covers a curriculum which has an institutional background static/in his own university, Glasgow. This was a curriculum crucially influenced by Hutcheson’s predecessor Gershom Carmichael, and at its center was modern natural jurisprudence as systematized by Grotius, Pufendorf, and others… . The Institutio is the first major [published] attempt by Hutcheson to deal with natural law on his own terms… . It therefore encapsulates the axis of natural law and Scottish Enlightenment ideas, which so many other thinkers, including Adam Smith, worked with in their different ways. It is of great significance that this work issued from the class in which Smith sat as a student.”

1747 - Jean-Jacques Burlamaqui
The Principles of Natural and Politic Law
The basis of this version of The Principles of Natural and Politic Law is Thomas Nugent’s 1763 English translation, which became a standard textbook at Cambridge and at many premier American colleges, including Princeton, Harvard, and the University of Pennsylvania. The first scholarly work on Burlamaqui was written by an American, M. Ray Forrest Harvey, who in 1937 argued that Burlamaqui was well known among America’s Founding Fathers and that his writings exerted considerable influence on the American constitutional system. In his introduction, Nugent said of Burlamaqui: “His singular beauty consists in the alliance he so carefully points out between ethics and jurisprudence, religion and politics, after the example of Plato and Tully, and the other illustrious masters of antiquity.”

1754 - David Fordyce
The Elements of Moral Philosophy
Fordyce’s Elements of Moral Philosophy was a notable contribution to the curriculum in moral philosophy and was one of the most widely circulated texts in moral philosophy in the second half of the eighteenth century.

1762 - Henry Home, Lord Kames
Elements of Criticism, vol. 1
Elements of Criticism, vol. 2
A two volume work on the “science of criticism” by one of the leading figures of the Scottish Enlightenment. Kames argues that criticism of art and literature is a rational science as well as a matter of taste.
In volume 1 he explores the nature and causes of the emotions and passions.
In volume 2 he explores the principles of rhetoric and literary appreciation, and discusses the formation of our standards of taste.

1771 - John Millar
The Origin of the Distinction of Ranks
The Origin of the Distinction of Ranks is one of the major products of the Scottish Enlightenment and a masterpiece of jurisprudence and social theory. Millar developed a progressive account of the nature of authority in society by analyzing changes in subsistence, agriculture, arts, and manufacture. The book is perhaps the most precise and compact development of the abiding themes of the liberal wing of the Scottish Enlightenment. Drawing on Smith’s four-stages theory of history and the natural law’s traditional division of domestic duties into those toward servants, children, and women, Millar provides a rich historical analysis of the ways in which progressive economic change transforms the nature of authority. In particular, he argues that, with the progress of arts and manufacture, authority tends to become less violent and concentrated, and ranks tend to diversify. Millar’s analysis of this historical progress is nuanced and sophisticated; for example, his discussion of servants is perhaps the best developed of the “economic” arguments against slavery.

Written late in his life, this 3 volume work deals with the idea of human progress.
Vol. 1 deals with progress in property law, commerce, the treatment of women, and luxury.
Vol. 2 deals with the development of states, government, and taxation.
Vol. 3 deals with the progress of science.

1779 - Henry Home, Lord Kames
Essays on the Principles of Morality and Natural Religion
The Essays is commonly considered Kames’s most important philosophical work. In the first part, he sets forth the principles and foundations of morality and justice, attacking Hume’s moral skepticism and addressing the controversial issue of the freedom of human will. In the second part, Kames focuses on questions of metaphysics and epistemology to offer a natural theology in which the authority of the external senses is an important basis for belief in the Deity.

1784 - Jean Louis De Lolme
The Constitution of England; Or, an Account of the English Government
The Constitution of England is one of the most distinguished eighteenth-century treatises on English political liberty. In the vein of Charles Louis Montesquieu’s Spirit of the Laws (1748) and William Blackstone’s Commentaries on the Laws of England (1765–1769), De Lolme’s account of the English system of government exercised an extensive influence on political debate in Britain, on constitutional design in the United States during the Founding era, and on the growth of liberal political thought throughout the nineteenth century.

1791 - Sir James Mackintosh
Vindiciae Gallicae and Other Writings on the French Revolution
Vindiciae Gallicae was James Mackintosh’s first major publication, a contribution to the debate begun by Edmund Burke’s Reflections on the Revolution in France. The success of Mackintosh’s defense of the French Revolution propelled him into the heart of London Whig circles. The turn of events in France following the September 1792 Massacres caused Mackintosh, along with other moderate Whigs, to revise his opinions and to move closer to Burke’s position. A Discourse on the Law of Nature and Nations was the introduction to a popular course of public lectures at Lincoln’s Inn in 1799 and 1800. These lectures provided Mackintosh with an opportunity to complete the evolution of his political thought by expounding the principles of a Scottish version of the science of natural jurisprudence dealing with “the rights and duties of men and of states,” to announce his withdrawal of support for the French Revolution, and to criticize former allies on the radical wing of the reform movement. The Liberty Fund edition also includes Mackintosh’s Letter to William Pitt, an attack on the prime minister, Pitt the Younger, for going back on his own record as a parliamentary reformer; and On the State of France in 1815, his reflections on the nature and causes of the French Revolution.

1803 - John Millar
An Historical View of the English Government
An Historical View of the English Government consists of three parts, concerned with the most substantive revolutions in English government and manners: from the Saxon settlement to the Norman Conquest, from the Norman Conquest to the accession of James I, and from James I to the Glorious Revolution. Through these three phases Millar traces the development of the “great outlines of the English constitution”—the history of institutions of English liberty from Saxon antiquity to the revolution settlement of 1689. Millar demonstrates serious concern for the maintenance of liberties achieved through revolution and maintains that the manners of a commercial nation, while particularly suited to personal and political liberty, are not such as to secure liberty forever.
